When the European Commission published its preliminary draft directive on which sectors to include in the carbon emissions trading scheme (ETS), business jet operators heaved a sigh of relief when they were not named.

But the subsequent release of the final draft directive in December could smudge the silver lining. It makes for the inclusion in the system of all aircraft above 5,700kg maximum take-off weight without any reference to the number of seats. The final draft does not include any proportionality measure, meaning that even the smallest operations will be included.

This lack of proportionality is also in conflict with the preliminary directive on fixed instillations, which provides for a threshold level of emissions below which installations are excluded.
